Collin, Tarrant, Dallas are a few of the appraisal districts which have filed a brief to the U.S. Supreme Court concerning the taxability of tank farms or underground storage tanks taxability of oil & gas. There are two cases pertaining to this issue and in both cases the Texas Appeals courts concluded that the oil & gas were exempt from taxation due to the dormant commerce clause and a product of interestate transit. The Texas Supreme Court declined to rehear these cases. A writ of certiorari have been petitioned to the U.S. Supreme Court. The court will decide in April whether to hear them or not.
